TARGET advised Pacifico Topazio in proceedings before the Italian Council of State, which concluded with judgment No. 6004/2026. The Council dismissed the appeal brought by the Lombardy Region and upheld the annulment of the so-called “Agrivoltaic Resolution”, as well as the subsequent decision to close the company’s authorisation application for the development of an agrivoltaic project in the Province of Mantua.
The dispute concerned, in particular, the extent to which regional authorities may introduce additional requirements and restrictions beyond those established by the national regulatory framework for the development of renewable energy projects.
In its judgment, the Council of State confirmed the annulment of the challenged regional measures, reaffirming an important principle for the development of renewable energy projects and clarifying the limits within which regional authorities may impose requirements and restrictions on renewable energy installations.
The judgment forms part of the broader body of case law concerning the relationship between the national regulatory framework governing the energy transition and regional powers, and is particularly relevant for operators involved in the development of agrivoltaic and, more generally, renewable energy projects.
